How Dram Shop Law Works

Dram Shop Law examines whether an alcohol seller or provider may share responsibility for harm caused by an impaired driver. The analysis commonly considers what the provider knew or should have recognized, what alcohol service occurred, and whether that service contributed to the person’s impairment. The injured person must connect the provider’s conduct to the crash and resulting damages.

Evidence may include receipts, business records, witness accounts, surveillance footage, messages, and toxicology information. Georgia claims also depend on the facts and legal rules that apply to the provider, the drinker, and the injured person. A claim against an alcohol provider can exist alongside a claim against the driver, but each claim requires its own proof.

From the Atlanta Auto Law team

When we review a drunk driving accident claim, we identify where the driver obtained alcohol and preserve evidence about the service. We examine witness accounts, records, and the timing of the crash. Our team also connects the provider’s conduct to the injuries without treating provider liability as automatic.
