What Are Damages?

Damages are the losses a person may seek to recover after another party causes a personal injury. They can address financial harm, physical pain, emotional distress, reduced ability to work, and other proven effects. A claim may involve economic damages, noneconomic damages, or punitive damages when the facts support them.

How Damages Works

Damages

Damages in a personal injury claim are assessed by linking each loss to the incident and the resulting injury. Economic damages may include medical bills, lost wages, and necessary care. Noneconomic damages may address pain, emotional distress, and effects on daily activities.

Related glossary terms: Economic Damages, Pain and Suffering, Punitive Damages.

Records help show what happened and how the injury affected your life. Medical records can connect treatment to the incident, while wage records can support lost income. The available evidence also helps separate losses caused by the injury from unrelated conditions. Economic damages and pain and suffering may be evaluated separately, although both can arise from one event.
