What Is a Witness Statement?

A Witness Statement is a written or recorded account from someone who saw, heard, or experienced an event. In a car accident claim, the statement may describe traffic conditions, vehicle movements, the collision, and visible injuries. The witness usually gives the account based on personal knowledge, not guesses or information from others.

  • A witness statement is not the same as an affidavit.

How Witness Statement Works

A person holds a paper labeled “WITNESS STATEMENT” at a wooden desk beside a computer monitor

A Witness Statement preserves a person's account of an event in a form that can be reviewed later. The account may come from a driver, passenger, pedestrian, or bystander. A useful statement identifies what the witness personally observed and separates those observations from assumptions.

Related glossary terms: Affidavit, Expert Witness, Medical Records.

In a car accident claim, the statement may address the direction of travel, traffic signals, vehicle sounds, road conditions, and what happened after impact. A lawyer may compare the account with Medical Records, photographs, vehicle damage, and other evidence. A witness may later be asked to clarify the statement, but the written account does not replace testimony when testimony is required.

From the Atlanta Auto Law team

When we review a witness statement, we compare its details with the accident report, photographs, medical records, and other available evidence. We also separate firsthand observations from conclusions or information the witness heard from someone else. That review helps us assess how the statement fits the broader claim.

Witness Statement in Practice: A Real-World Example

A driver stopped near a Druid Hills intersection may state that a vehicle entered the intersection after the traffic signal changed. The account may help compare the driver's observation with vehicle damage, roadway photographs, and other evidence.
