What Is a Settlement Demand?

A settlement demand is a formal request for an insurance company or opposing party to resolve a personal injury claim for a stated amount. The demand usually explains liability, describes the injury, documents losses, and identifies the compensation sought. It begins settlement discussions but does not itself create a binding agreement.

Key Takeaways About Settlement Demand

  • A demand presents a supported request, not an automatic payment.
  • Evidence and documented losses shape the requested resolution.
  • A settlement demand is not the same as a signed settlement.

How Settlement Demand Works

Settlement Demand

A settlement demand organizes the claim's facts and presents a proposed resolution to the party responsible for payment. The document may connect the accident to the injury, explain the legal basis for responsibility, and describe losses supported by available records. Its strength depends on how clearly the evidence supports the requested amount.

The recipient may accept the request, reject it, ask for more information, or respond with a different proposal. Negotiations can address responsibility, medical documentation, lost income, property damage, and the effect of the injury on daily life. A written response does not complete the case unless the parties reach agreement and document the settlement. A medical record or insurance coverage information may affect the discussion without deciding the result alone.

From the Atlanta Auto Law team

When we prepare a settlement demand, we organize the available evidence around responsibility, injury, and documented losses. We check that the requested resolution matches the facts and that supporting records address the issues an insurer or opposing party may raise.

Settlement Demand in Practice: A Real-World Example

After a distracted driver causes a collision, a personal injury attorney sends a settlement demand describing the crash, the client's injuries, treatment, and related losses. The document requests a negotiated resolution based on the available evidence and leaves room for a response.
